Can I back file for a 1098-T form for the previous 2 years?

Postby tiladene4 » Wed Jan 12, 2011 12:48 am

I didn't file my Tuition on my Taxes the past 2 years therefore I didn't get the benefit. I am filing my tuition this year and was wondering if I can amend and file for the past 2 year also. I was a full time student for all 3 years working on my first BA and I didn't get the tax break for that in 2008 and 2009. Can I get back paid? And how will I file it I have 3 1098-T forms 2008-2009-2010. Thanks

You must file amended tax returns (Form 1040X) for each affected prior year. You can't load them all on your 2010 return. Each year stands alone.

You don't file a 1098-T. You use it to remind yourself of what you spent on tuition that year.

For 2008, the education credits can only lower your tax bill. If you didn't owe, you don't need the credit.

For 2009, there is a refundable credit, but if you are under 24, single and either parent is alive, you can only claim it if a) you weren't a dependent and b) your earned income is more than half of your total support.

Yes,

You can go back and amend your tax returns for previous years using form 1040-X.

You must file a separate amendment for each year you wish to change.

If the change results in an additional refund, then you'll get the refund as long as the amendment is filed within 3 years of the original filing deadline for that year. That means its already too late to claim a refund for 2006 or earlier. The last day to amend and claim a refund for 2007 will be April 15th 2011, the last day to amend and claim a refund for 2008 will be April 15th 2012, etc.

If you'll get anything for it, you can amend your last 2 years returns.
